| Agreement to Collaborate on the International Exquisite Corps Project |
| Definitions: “International Exquisite Corps Project” or “the Project” means project in which works of visual art are created in stages by multiple artists working in collaboration.
“High Resolution” means above 300 pixels per inch. Each Contributing Artist of International Exquisite Corps Project will be the owner, subject to the conditions and limitations provided herein, of each and every material work of visual art he or she independently creates for each stage. Each Contributing Artist will be the copyright owner, subject to the conditions and limitations provided herein, of each and every work he or she submits in the Primary Stage, each and every work resulting from a Mid-Stage in which he or she is the last Contributing Artist, and each and every work he or she creates as a Finished Piece. A Finished Piece will not be downloadable and altered further by anyone in or outside of the Project except for purposes provided herein. Each and every work an artist submits in the Primary Stage, alters in Mid-Stage, and creates as a Finished Piece will have his or her name accessible on that stage of the work with which the artist helped. I, Mary Corey March, agree to the following as Project Coordinator of the International Exquisite Corps Project: I will not share High Resolution digital images or files of the work in the Project with anyone outside of the Project. They will be shared with the 19 other artists involved and the web developer, Chris SaariI will not share High Resolution digital files of pieces designated as “Finished” by the artists with anyone except the web designer (for web-use and size alteration only). I retain the right to reproduce, distribute, and display Low, Medium, and High Resolution versions of digital images or files of Project work to enter into art contests, shows, and competitions and use for websites, books, prints, and gallery shows. I may also use the name and public information about Contributing Artists and their work for the purposes provided herein. I will donate any profit from single physical prints of work I create (posters, cards, high quality prints) entered in the Project shall be donated to an internationally-oriented charity, at present designated as “Children International.” I will give credit to Contributing Artists by presenting their names in any and all reproductions, distributions, and displays of their work by me. If any information on a work of visual art or about an artist is incorrect and I am informed of the error by the artist, I will correct it without penalty at the first available opportunity. As a Contributing Artist in the International Exquisite Corps Project I agree to the following: I will upload one work of visual art in a Primary Stage and make at least three alterations to work in Mid-Stages. I will create at least one Finished Piece. I will upload only my own work of visual art and my own alterations to work within the Project. I understand that when I upload a High Resolution file of a work "in progress," it will be available to all other artists in the Project to download and alter. I will not reproduce, distribute, or display any work which I did not submit in a Primary Stage, alter in Mid-Stage as the last Contributing Artist, or create as a Finished Piece. I will not reproduce, distribute, or display the digital images or files of the Progression Tree and/or websites without informing and getting consent from Mary Corey March. I grant Mary Corey March the right to reproduce, distribute, and display Low, Medium, and High Resolution versions of digital files or images I upload for entry into art contests, shows, and competitions and use for websites, books, prints, and gallery shows. I also grant Mary Corey March the right to use my name and public information about me and my work for the purposes provided herein. I will notify the recipient or viewer of the Project and give other Contributing Artists and Mary Corey March, Project Coordinator, credit in my reproductions, distributions or displays of my work over which I have copyright ownership. I accept that Low Resolution versions of the work displayed online may be copied by the general public, and I do not hold Mary Corey March responsible for any alteration, reproduction, distribution, or display of Low Resolution digital images or files from the website by the public. I understand that sometimes webpages experience technical difficulties and will not hold Mary Corey March responsible for server failures or general web gliches. I agree to indemnify, defend, protect, and hold harmless Mary Corey March from and against all losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees and expenses), claims, suits, demands, actions, or causes of action of whatever kind or nature with a third party arising out of or in connection with, or alleged to arise out of or in connection with, my (1) infringement or misappropriation of intellectual property rights or (2) breach of any term or condition of this Agreement. My participation in the Project will be in compliance with all applicable federal, state, or local laws, rules, and regulations. |
